Rocky Flats Cleanup Agreement

Before Rocky Flats can demolish former nuclear buildings, equipment must be safely deactivated and removed. This picture shows a Pencil Tank being removed from Building 779. Pencil Tanks are geometrically safe configurations used to hold/store process solutions containing Uranium or Plutonium.On July 19, 1996, the U.S. Department of Energy (DOE), Colorado Department of Public Health and the Environment (CDPHE) and U.S. Environmental Protection Agency (EPA) entered into an agreement called the Rocky Flats Cleanup Agreement (RFCA) for the cleanup and closure of Rocky Flats. RFCA creates a framework for decisions to be made rapidly, assigns funding to the highest Site priorities, and places all Site activities in an integrated sitewide baseline.

Proposed modifications to certain RFCA Attachments were released for public review and comment by the RFCA Parties, DOE, EPA, and CDPHE, on November 12, 2002. After consideration of public comments received and incorporation of changes deemed necessary for approval, CDPHE and the EPA approved modifications to RFCA Attachments 5 and 10, and a new Attachment 14 on June 5, 2003. These Attachments are dated May 28, 2003.

A Response to Comments has been prepared to document the RFCA Parties' consideration of the comments received regading the final modifications. Please refer to the Response to Comments for specific comments and responses.

While RFCA contains the usual legal elements common to environmental compliance agreements, there are major elements that set it apart from other such agreements throughout the DOE complex, such as a closure vision statement; goals and objectives to achieve the vision; a description of the regulatory process and legal framework; action levels and cleanup standards framework for surface water, groundwater and soils; building disposition process and standard; environmental restoration ranking; and no action/no further action/no further remedial action decision criteria.

In October 2003, the 2003 Rocky Flats Cleanup Agreement Annual Review was published. This report is a summary of the 2003 RFCA Annual review process and conclusions. The following environmental laws and associated regulations, written policy and guidance were reviewed:

  • Resource Conservation and Recovery Act/Colorado Hazardous Waste Act
  • Toxic Substances Control Act
  • Clean Water Act, Colorado Water Quality Control Act, Safe Drinking Water Act
  • National Environmental Policy Act

  • Radiation Related Document Review
  • Defense Authorization Acts and Appropriation Acts

In addition to the above environmental laws and the radionuclide soil action levels, the Preliminary Remediation Goals (PRGs), RFCA Attachment 5, Table 1, and RFCA Appendix 3, Implemenation Guidance Document were reviewed. Summaries of these reviews are described in the document.
